Acceptance of Terms

By visiting, browsing, or otherwise using any service operated by chicpack Store, you confirm that you have read, understood, and agreed to be bound by these Terms of Service together with all federal, state, and local laws and regulations that apply to you. Should you disagree with any portion of these Terms, you must refrain from using chicpack Store's services entirely. Where you access our services in a business or organizational capacity, you represent and warrant that you hold the authority necessary to bind that entity to these Terms.

Use of the Website

Unless chicpack Store has granted you prior written authorization, you may use our services solely for lawful, personal, and non-commercial purposes. The following conduct is prohibited:

• Acting in violation of any applicable law or regulation, including consumer protection and product safety requirements
• Sending unsolicited advertising, promotional content, or spam through our platform
• Seeking unauthorized entry to our systems, customer accounts, or inventory databases
• Posing as any individual or organization, including chicpack Store personnel or other customers
• Deploying automated tools, scrapers, or bots to harvest pricing, inventory, or user information from our platform
• Submitting fraudulent, excessive, or malicious orders, including orders placed without any genuine intent to receive the goods
• Reselling chicpack Store products for commercial purposes without our explicit written consent

Product Information and Pricing

chicpack Store works diligently to keep product descriptions, prices, specifications, and availability information accurate and current. Should an error affect product information, pricing, or availability, chicpack Store may correct that error and cancel any order placed on the basis of the incorrect information, at no cost to you. For goods that naturally vary (such as handmade items or products made from natural materials), minor differences in dimensions, weight, or appearance from the listed specifications may occur. Product details and warnings are furnished for reference only; chicpack Store cannot warrant that products are entirely free from cross-contamination during processing or packaging. Availability may differ depending on your delivery zone, chosen pickup location, and selected time slot.

Orders and Payment

Every order remains subject to product availability and to acceptance by chicpack Store. chicpack Store may decline or cancel any order at its sole discretion, including orders that appear fraudulent, breach these Terms, or cannot be fulfilled because of stock shortages. Full payment is required before an order is dispatched or collected, unless chicpack Store agrees otherwise in writing. Minimum order values and delivery fees may apply according to your delivery zone and chosen time slot. Where age-restricted products are sold (including alcohol, tobacco, and vaping products where permitted by law), you must meet the legal purchasing age in your jurisdiction, and a valid government-issued ID will be required upon delivery or pickup. If an item in your order is unavailable, chicpack Store will contact you before dispatch and may propose a suitable substitute or refund the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All materials appearing on chicpack Store's platforms — including text, images, logos, software, private label product packaging, and the "chicpack Store" name and branding — belong exclusively to chicpack Store and are safeguarded by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any chicpack Store content without our express written permission. User-generated content (including product reviews, photos, and comments) that you submit to our platforms may be used by chicpack Store for marketing, promotional, or operational purposes, in accordance with our Privacy Policy.

User Responsibilities

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must promptly notify chicpack Store of any unauthorized account use or other security breach. You are likewise responsible for supplying accurate, current contact, delivery, and payment details when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you provide are truthful and complete. If you place an order on behalf of a third party, you bear sole responsibility for confirming that the third party satisfies all legal eligibility requirements for the purchased products, including age restrictions for restricted goods.

Limitation of Liability

To the maximum extent permitted by law, chicpack Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including but not limited to damages for incidental loss or delivery delays. Our total aggregate liability to you for any claim arising from a single transaction shall not exceed the total amount you paid for the products or services in question. chicpack Store is not responsible for service failures or delays caused by circumstances beyond our reasonable control, including but not limited to supply chain disruptions, severe weather, public health emergencies, or third-party carrier delays.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of chicpack Store's services shall first be submitted to chicpack Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

chicpack Store may update, modify, or replace any portion of these Terms at any time at its sole discretion. Where we make material changes to these Terms, we will give at least 30 days' advance notice by email to the address associated with your account, or through a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using chicpack Store's services prior to the effective date of the changes.
